Does it matter how long my spouse and I have been married prior to filing the I-485?
Yes. If you were married less than two years prior to filing your I-485 application, then you must provide evidence that you have a bona fide marriage along with your I-485. Providing as much of the following documentation as possible will help establish a bona fide marriage:
- Joint ownership or leasehold of property (house, car, etc.)
- Joint bank account/credit card statements
- Joint tax returns
- Birth Certificates for your children
- Other documentation showing that you have a bona fide marriage (USCIS will not consider photos as evidence)
